Terms & Conditions for Photography Services

[Bless] (hereafter “Photographer”) and Client (hereafter “Client”)
1. Appointment & Booking
1.1 A session is confirmed once the Client has signed this agreement (or accepted the online terms) and paid the agreed deposit.
1.2 The Photographer reserves the date and time of the session upon confirmation.
1.3 Any changes to date/time or location must be agreed in writing by both parties.
2. Payment & Fees
2.1 The agreed session fee shall be as per the selected package.
2.2 A non-refundable deposit of [10.000] is required to secure the booking. The remainder must be paid by [date or condition].
2.3 If the Client fails to pay by the due date, the Photographer reserves the right to cancel the session and retain the deposit.
3. Cancellation & Rescheduling
3.1 If the Client cancels the session more than 72 hours prior to the date, the deposit may be applied to a rescheduled date at the Photographer’s discretion.
3.2 If cancellation occurs within 72 hours of the session, no refund of deposit will be issued.
3.3 If the Photographer is unable to perform the session due to circumstances beyond their control (illness, accident, force majeure), the Photographer will endeavour to provide a substitute or refund payments. The Photographer’s liability is limited to the amount paid by the Client.
4. Session Delivery
4.1 The agreed number of edited photographs will be delivered via online gallery or other medium within [21 days] following the session.
4.2 The Client may purchase additional images and/or upgrade to a full gallery as per current pricing.
4.3 The Photographer retains full discretion over photographic style, lighting, selection of final images, and choice of backgrounds/locations unless otherwise agreed in writing.
5. Copyright & Usage Rights
5.1 The Photographer retains copyright in all images created, pursuant to the Icelandic Copyright Act No. 73/1972 and applicable amendments.

5.2 The Client is granted a non‐exclusive, non-transferable licence to print and share the delivered images for personal, non-commercial use unless otherwise agreed in writing.
5.3 Any reproduction, commercial use, alteration or publication of images by the Client beyond the licence granted is prohibited unless separate written permission is obtained and usage fees may apply.
5A.1 All photographs created by the Photographer remain the sole and exclusive property of the Photographer under Icelandic Copyright Act No. 73/1972, regardless of whether digital files, prints, or other products are supplied to the Client.
5A.2 The Photographer retains full copyright and moral rights to all images. The Client receives a limited, non-exclusive licence for personal use of the final delivered images (e.g., printing, private sharing, personal social media posts).
5A.3 The Photographer may use any image created during the session for advertising, promotion, website display, studio portfolio, printed materials, exhibitions, publication, or social media, unless the Client requests in writing before the session that their images remain private.
5A.4 The Photographer is not required to seek further approval for such use and no additional compensation will be due to the Client.
5A.5 If the Client wishes to restrict the use of specific images (e.g., for privacy or child protection reasons), this must be agreed upon in writing before the delivery of the final gallery.
5A.6 The Client understands that declining image use may limit the Photographer’s ability to feature their session publicly but does not affect copyright ownership.
6. Model Release & Publicity
6.1 The Client grants the Photographer the right to use delivered images for the Photographer’s promotional purposes (portfolio, website, social media, exhibitions) unless otherwise indicated in writing.
6.2 If images include minors, the Client (as parent/guardian) confirms they have the necessary rights to grant the licence and release.
7. Liability & Limitations
7.1 The Photographer is not responsible for coverage failure or missed shots due to causes beyond their control, including but not limited to: late arrival by the Client or subjects, unsuitable lighting/locations, weather, or interference by third parties.
7.2 In the event of technical failure, camera malfunction, data loss or other uncontrollable incident, the Photographer’s liability is limited to a refund of the session fee paid.
7.3 The Client agrees to indemnify and hold harmless the Photographer from claims, damages or liability arising from participation in the session.
8. Travel, Location & Expenses
8.1 If the session is scheduled at a location outside the Photographer’s standard area, the Client is responsible for travel, accommodation, parking, meals or other related expenses as agreed in writing.
8.2 The Client is responsible for ensuring the session location permits photography and must comply with local rules and regulations.
9. Client Responsibilities
9.1 The Client must arrive on time at the agreed location. If the Client or guests are late, the session end time remains as originally scheduled. Additional time may incur extra charges.
9.2 The Client must ensure all subjects (including children) are present and ready at start time. The Photographer is not obligated to wait or extend the session beyond the scheduled end time.
10. Data Retention & Gallery Expiry
10.1 The online gallery will be accessible for 7 days from delivery.
10.2 The Photographer is not obliged to hold raw/unedited files by any means, unless otherwise agreed in writing.
10.3 The Client should select their favourites within this period; requests for re-edits, backups or reshoots beyond this may incur fees.
11. Governing Law & Dispute Resolution
11.1 This agreement shall be governed by the laws of the Republic of Iceland.
11.2 Any dispute arising under or in connection with this agreement shall be resolved by negotiation in good faith; failing which, the dispute may be submitted to the Reykjavík District Court (or other agreed jurisdiction) in Iceland.
12. Miscellaneous
12.1 This agreement (including any schedules or addenda) constitutes the entire agreement between the Photographer and the Client; it supersedes all prior understandings, representations or agreements (written or oral).
12.2 No variation to this agreement shall be effective unless in writing and signed (or accepted digitally) by both parties.
12.3 If any provision of this agreement is found invalid or unenforceable under Icelandic law, the remainder of the agreement continues in effect.
12.4 The Photographer may assign their rights and obligations under this agreement to another party (e.g., substitute photographer) provided the standard of service remains comparable.

No-Show & Cancellation Policy

By booking with Bless Studio, you agree to attend your scheduled appointment.
If you fail to attend your session or cancel with less than 48 hours’ notice, Bless Studio reserves the right to charge a no-show fee of 15,000 ISK.

Cancellations must be made in writing via email or through the booking system.
No charge applies if the cancellation is made more than 24 hours in advance.

By completing your booking, you acknowledge and accept these terms.
